Call it what you will, but there is no denying that the drug is taking a strong legal foothold in the United States. Even though marijuana use and possession is against Federal law, 30states and the District of Columbia have adopted the legalization of marijuana in some form. For the vast majority of states, that means the use of medical marijuana (although the limitations and conditions for that medical use vary from state to state). Eight states have basically legalized marijuana completely, meaning both medical and recreational sales are not only allowed, but are flourishing. Most recently, California kicked off 2018 with recreational-use marijuana, and by July of 2018 Massachusetts will have joined the club that also includes Alaska, Colorado, Maine, Nevada, Oregon, and Washington. While there are still furious debates about the legality of this, and whether or not some states will switch back to medical-only marijuana, or complete prohibition, there is no doubt that while its legal in the state, companies are ready to make millions of dollars from it. But that begs the questionhow do you advertise something that is against Federal law? What Are the Choices for Marijuana Advertisers? As you can imagine, the options available for marijuana advertisers right now are slim to say the least. Byfar and away the easiest way to advertise, and the cheapest, is through Google. But Google strictly prohibits the advertising of recreational drugs, with a prohibited list that includes Cocaine, crystal meth, heroin, marijuana, cocaine substitutes, mephedrone, and legal highs. Interestingly enough, psilocybin mushrooms are missing from the list, as well as the most pervasive legal drug of allalcohol. Tobacco is also banned, and that includes rolling papers, pipes, cigars, chewing tobacco and all other related products. Mainstream advertisin g is also a tricky prospect. Although billboards, four-sheets, and other outdoor advertising mediums have advertised marijuana products and companies in the past, its a rare occurrence. Even if you live in a state where almost all forms of cannabis are legal, like Colorado for example, you will not see an abundance of outdoor ads for the products. The main reason for this is simple- very few companies want to poke the bear that is the Federal Government. Its one thing to do your own thing in your own state, and keep your marijuana products to your own citizens. Its quite another to buy large chunks of outdoor media, proudly advertising legal highs and the latest in edibles and high-potency strains. So, for the most part, the marijuana companies are keeping everything on the down low. Thats not to say they are steering clear from any kind of advertising or marketing. While some of the more mainstream, traditional media choices are not in consideration, there are other avenues open to businesses selling legal marijuana. Perhaps the best is social media. Facebook, Twitter, Pinterest, Instagram and Imgur are all viable options for a legal weed dispensary, or the makers of the products they dispense. For example, Dixie Brands is a company that welches founded in 2009 and has a professional and educational presence on social channels, including an impressive Facebook page, a Twitter feed that has almost 27,000 followers, and an Instagram page. Unlike traditional advertising, these social pages are incredibly cost effective, and allow the brand to reach out directly to a targeted consumer. This is not a mass-market approach, but a micro-marketing strategy, and rightly so. Despite widespread acceptance in many places, there are an awful lot of people that just dont want to see ads for cannabis. By being selective, using geo-targeting, and perhaps a local fly-posting or leafleting campaign, marijuana businesses can get granular with a campaign. Which Specific Rules and Laws Currently RegulateMarijuana Advertising? As you can imagine, the rules and laws surrounding the advertising of a Federally-banned drug are in a constant state of flux due to the legality of the product in various states. Whats more, the rules that are put in place by the individual states will also change and be altered over time. Even in states where marijuana is 100 percentlegal, regardless of the requirement for a medical note, can have some very strict regulations on advertising cannabis. This is not entirely unexpected. Tobacco advertising has undergone significant changes over the decades. A once wholesome product advertised by doctors, actors, and even childrens television shows (The Flintstones actually advertised cigarettes) was deemed to be a killer, and over time the restrictions grew so tight that tobacco had almost nowhere left to turn. Those ads you saw in Mad Men (its toasted) and Seinfeld (featuring Kramer as a 30 ft. tall smoking cowboy) are a thing of the past. Leafly, a website dedicated to being a valuable information resource on cannabis products, has a complete rundown on the laws, rules, and regulations for each and every state. Heres an example of the laws around advertising marijuana in a state that is anti-marijuana, Georgia Georgia does not allow dispensaries, nor advertising for their medical cannabis law. Pretty clear cut. Compare that to a state that allows recreational marijuana, and youll see a completely different story. For example, this is just a small sample from the Colorado list of rules R 1102- Advertising General Requirement No Deceptive, False or Misleading Statements A Retail Marijuana Establishment shall not engage in Advertising that is deceptive, false, or misleading. A Retail Marijuana Establishment shall not make any deceptive, false, or misleading assertions or statements on any product, any sign, or any document provided to a consumer. R 1104- Advertising Television A. Television Defined. As used in th is rule, the term television means a system for transmitting visual images and sound that are reproduced on screens, and includes broadcast, cable, on-demand, satellite, or web programming. Television includes any video programming downloaded or streamed via the internet. B. Television Advertising. A Retail Marijuana Establishment shall not utilize television Advertising unless the Retail Marijuana Establishment has reliable evidence that no more than 30 percent of the audience for the program on which the Advertising is to air is reasonably expected to be under the age of 21. R 1105- Advertising Radio A. Radio Defined. As used in this rule, the term radio means a system for transmitting sound without visual images, and includes broadcast, cable, on-demand, satellite, or internet programming. Radio includes any audio programming downloaded or streamed via the internet. B. Radio Advertising. A Retail Marijuana Establishment shall not engage in radio Advertising unless the Retail Mar ijuana Establishment has reliable evidence that no more than 30 percent of the audience for the program on which the Advertising is to air is reasonably expected to be under the age of 21. R 1106- Advertising Print Media A. Retail Marijuana Establishment shall not engage in Advertising in a print publication unless the Retail Marijuana Establishment has reliable evidence that no more than 30 percent of the publications readership is reasonably expected to be under the age of 21. That represents less than half of the regulations surrounding the advertising and marketing of a cannabis product. The list goes on to include rules for signage, Internet, and even darbietung sponsorship. A legal minefield indeed. How About Educating the Consumer? Does That Count as Advertising? Most definitely, but it is far better to go out with an education campaign than something that merely promotes the products and its effects. With legal marijuana comes a whole world of questions and concerns. Wh ereas the traditional cannabis smoker may have had many years to experience the drug and its effects, people new to edibles and other marijuana products will want answers to some burning questions. How much should I take?What does it cost?What if I take too much?Can I mix it with beer or wine?Will I get arrested if I dont have a medical use?What about driving? Legal cannabis businesses are more than happy to answer these questions, and if its done in the right way, it can be very effective. Because many news producers who write the scripts are young and inexperienced, lazy anchors are putting their r eputation in the hands of a potential rookie. Assume Youre Not on the Air/Microphones Are Not Hot Many TV news bloopers are committed by news anchors who assume theyre not on the air and their microphones are turned off. That is a risky assumption to make. Production technicians make mistakes. Sometimes the equipment doesnt work properly. In either case, if a news anchor is telling a dirty joke to a colleague during a commercial break, he could accidentally be on the air when he thinks hes in the clear. A viewer who witnesses the joke-telling is going to blame the anchor for being a bonehead, regardless of whether a behind-the-scenes mishap was responsible for the error. Panic Every news anchor is going to be put into a high-pressure situation while sitting at the anchor desk. Perhaps its during an unscripted breaking news event. Something goes wrong, so the people in the control room ask the anchor to fill some time while they work out the problem. Adlibbing on TV comes eas y to some anchors, but its a struggle for others. But even in the highest-stress environment, an anchor has to maintain a sense of calm and control and not look confused, overwhelmed or fearful. Yawn There are days that any job is boring, including being on a live TV newscast. That doesnt give a news anchor permission to look bored or tired on the air. One of the keys to being a good anchor is having a high-energy level on the air. An anchor has to look interested in the information and appear eager to tell viewers about it. Getting caught yawning on the air ruins the atmosphere that the station is attempting to create. Get Angry or Curse Even at the network level, there are newscasts that implode for one reason or another. Maybe there was an egregious factual error in a script. Maybe none of the videos ran properly because of equipment failure. A news anchor can never show gemeindeland at these mistakes or be seen yelling or cursing at someone or something. While anchors sh ould appear human on the air, thats one emotion that shouldnt be allowed to erupt at any time for any reason. ansicht days, an on-air explosion of anger will be posted on YouTube or on social media within minutes. An anchor would find it nearly impossible to recover from it. Smile or Laugh at Inappropriate Times Anger is never good. Smiling or even laughing is sometimes okay, but not during serious news. For example, a news anchor could be reading a story about child abuse, while off camera, someone walks in the studio, trips, and knocks over a bunch of props. That might be funny, but not in the context of what the viewer at home sees. Viewers might see the anchor get the giggles while speaking about child abuse. If that happened, an anchor would be forced to apologize on the air and explain why he was laughing. Show Bias A news anchor reads a story about the citys mayor making some outlandish proposal. Unfortunately, the anchor rolls his eyes in disgust when reaching the en d of the story, not realizing that everyone at home saw what happened. Certainly, word would reach the mayors office about what happened. That would doom the relationship the anchor has with city hall and might even hurt the stations relationship as well. These days, watchdog groups and critics are always on the lookout for political bias in news, either real or imagined. An anchors gestures shouldnt become ammunition against the station. Endorse a Product Its never a good idea to risk your impartiality in endorsing a product. You trade your credibility to become a pitchman. It will be very difficult to regain the audiences trust. But there are instances when you can mention a product or business. For instance, after a story about a festival celebrating Volkswagen Beetle cars, you could say that you used to own one and wished you still had it. Youre not telling viewers to go buy a VW. Another example is if your news kollektiv is collecting money for The Salvation Army outside of a Walmart store, you can tell people to come on down to Walmart to help a great cause. These are the exceptions, so be careful. Show Disrespect for a Co-Anchor Members of some news teams are genuine friends off the air. Other news teams have to fake it because in real life the anchors, meteorologist and sports anchor cant stand each other. But every news team should show on-air camaraderie, no matter what the reality may be. Viewers will feel uncomfortable watching a stations newscast if they feel as though there are problems with the anchor team. An anchor taking an on-air dig at a colleague would be a disaster. Sure, its sometimes fun to see an anchor take a good-natured ribbing. But viewers can detect disrespectful behavior. Insult a Guest There are times when even a mild-mannered news anchor has to ask tough questions of a guest while live on the air. But that should never cross the line into insulting behavior, which might be acceptable on talk radio, but not on a trad itional TV newscast. A news anchor must craft questions carefully so that while probing for information it never seems as though the anchor is belittling the person who may be evasive or becoming angry. It takes practice, a cool head and a realization that a host should always be welcoming to even the most difficult interview subject.
